Terms and Conditions for Tiger Balm Canada Facebook/Instagram Promotions
These terms and conditions apply to all Tiger Balm Canada Facebook and Instagram promotions, including but not limited to contests, giveaways, and sweepstakes, organized by Haw Par Healthcare Limited, Crossmark Canada, their affiliates, subsidiaries, advertising, and promotion agencies (“Tiger Balm Canada”). By participating in any promotion, you agree to these terms and conditions.
1) Eligibility: Promotions are open to individuals who are at least 18 years old and who reside in Canada. Employees of Tiger Balm Canada and their immediate family members or household members are not eligible to participate.
2) How to Enter: To enter, participants must follow the instructions outlined in the promotion post on Facebook or Instagram. Entries that are incomplete or do not comply with these terms and conditions will be disqualified.
3) Prizes: The prizes for each promotion will be listed in the promotion post on Facebook or Instagram. The prizes are non-transferable, non-refundable, and have no cash value. Tiger Balm Canada reserves the right to substitute a prize of equal or greater value at its sole discretion.
4) Winner Selection: Winners will be chosen at random from all eligible entries. The winner will typically be notified via Facebook or Instagram within 72 hours of the end of the promotion. If a winner does not respond within 72 hours, Tiger Balm Canada reserves the right to choose another winner.
5) Verification of Winners: To claim a prize, winners may be required to provide proof of identification and residency, a shipping address (note: PO boxes cannot be accepted), and a phone number. Failure to provide such proof may result in disqualification and forfeiture of the prize.
6) Publicity: By participating in a promotion, winners agree to allow Tiger Balm Canada to use their name, likeness, and any other information in promotional materials related to the promotion without further compensation or permission.
7) Release: By participating in a promotion, participants release and hold harmless Meta, Haw Par Healthcare Limited, Crossmark Canada, their affiliates, subsidiaries, advertising, and promotion agencies, and their respective officers, directors, employees, and agents from any and all liability, loss, or damage arising from or in connection with the promotion, the use or misuse of any prize, or participation in any promotion-related activity.
8) Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the province of Ontario without giving effect to any choice of law or conflict of law rules.
9) Disputes: Any disputes arising out of or related to the promotion shall be resolved individually, without resorting to any form of class action, and exclusively by the Ontario Small Claims Court located in Brampton, ON. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the promotion, but in no event attorneys’ fees. Under no circumstances will participants be permitted to obtain awards for, and participants hereby waive, all rights to claim indirect, punitive, incidental, and consequential damages and any other damages other than for actual out-of-pocket expenses.
10) Privacy: By participating in a promotion, participants agree to Tiger Balm Canada’s privacy policy, which can be found on the Tiger Balm Canada website.
